that would probably be because hutchinson whampoa! who run 3 are chinese and so they probably had the function to turn it off removed (just a guess but to me it sounds plausible)
i dont see why it should really make any sort of difference anyway, i think its quite a good idea to have shutter sounds

I have thought of one idea for those of you who can't turn off the sound. Why not create an mp3 of just silence (or possible record a sound on the k800 of silence) then assign this silence as the shutter sound!
