Blame the record companies more than Apple. If it weren't for FairPlay DRM and locking iTunes music to the iPod, Apple wouldn't be able to legally sell a single song. Steve Jobs himself has said as much.
Luckily, the tide's turning, as given by EMI's and Apple's big announcement of DRM-free music
