CPW have a 14 day exchange on all handsets unless you buy it as handset only which is exempt from being exchanged. If its faulty the phone is sent for repair which can take up to 1 month. Oh and CPW handsets do have branded firmware. Their handsets use the trade and vanilla software. Generic firmware has a different CDA than the CPW handsets

CPW (or any other retailer/dealer) probably won't officially admit to any problems but they must be noticing SERIOUS problems if they're swapping them over so readily.
Not necessarily - CPW have a policy of 28-day faulty exchange and it's also your statutory right under consumer law. It's standard practice for any new handset that goes wrong in the first four weeks from purchase.

About the bad reports, although my first K850i was fudged up and faulty, my second one is perfect. Everything works really fast with no problems, and I took over 50 pictures in pitch dark and they all came out perfect with not one problem with the flash.
So getting a faultless one I guess is just down to luck. Dealing with retail stores like CPW and getting several dodgy handsets can turn out to be a very bad experience as they tend to refuse to change them if you get a few dodgy ones, but I heard someone on O2 that got one through direct sales has had his changed 3 times and they dont say anything.
Hopefully you'll get lucky like me and get one without any problems, but a lot of people seem to be getting bad K850i's, so if you are willing to, it would be worthwhile to wait for a FW update and a new bacth of handsets.

Sale of Goods Act - 28 days exchange or money back if not fit for purpose.
Forget the 14 day and not eligible for exchange crap... you have 28 days from purchase and this resets for each new phone anyone gives you.
CPW have been excellent in my book at getting me to a 3rd K850 with no issues.

My sister works at CPW. They don't allow 28 day exchanges for handset only purchases. If the phone is faulty. They will send it off for repair (depending if the store has an on site repair center or not). Repair time varies between 28 days to anything up to 4 months.
CPW also regularly use reconditioned handsets to give to customers buying handset only.
P&G handsets are exactly the same ones but you get a sim card pack and a 14 day exchange (28 days for faults. Over 28 days and its reffered to manufacturer)
The following is taken from CPW's conditions of sale.
14 Day Exchange
If within 14 days of receiving your mobile phone* you are not entirely satisfied, we will be happy to exchange the phone, where permitted.
Please note: For iPhone, different policy applies. Click
here for more information.
The original mobile phone must be returned in "as sold" condition with the battery, charger, manual and any included accessories (but keeping the SIM card), the original packaging and receipt or other proof of purchase within 14 days of receiving it* and in any case within 7 days of notifying us of your wish to exchange it. Exchanges are subject to stock availability and are limited to one handset exchange. If the price of the exchange is more than the original product, you will be asked to pay the difference or, where it is less, we will refund the difference in accordance with our refund policy. For details of our exchange policies on other products, please ask in-store.
The 14 day exchange does not apply to iPhones, SIM free (unconnected) handsets, airtime only upgrades, hands-free units with earpieces that have been used, car kits once they have been installed, games, ring tones, downloads, Talk2Text, graphics, pre-pay airtime purchases (top-ups) and handset exchanges on the following networks: 3, Talkmobile, T-Mobile and Orange (unless faulty). Liability for the handset remains with you until we receive the handset. As such, we recommend the use of Royal Mail Special Delivery. Please ensure that any data that you wish to retain that has been put on the handset (contacts, photos, downloads, etc) has been saved elsewhere if possible as you will not be able to transfer the data once you have sent us the handset. This does not affect your statutory rights including where you are entitled to cancel your contract under the Consumer Protection (Distance Selling) Regulations 2000 (for sales via telephone, online or Sky Active) within 7 working days from the day after completing your order for services or receipt of the phone.

Got mine (on Orange 3/11/07) and it's, strangely for them apparently, silver
and blue - love it to bits colour wise. If I'm up for an exchange due to the
issues I'm having I'llbe getting a black and green one
