that was pretty bad of him imho. That man is going to hire man that smoke and can pottencially gain cancer in short time (even him). Is that his idea of revenge?

@mcrosser
As far as I understood the story, I don't think that revenge was his main motive. The non-smokers were causing trouble and therefore presumably disrupting the operation of the office and so possibly loosing the company money. If you cause too much trouble at work for whatever reason, you get the sack and so from that point of view I think he was quite within his rights and absolutely correct to do what he did.

I don't say it's wrong to fire them for disturbing the peace. I say he put's his health in danger by hiring people who smoke. There ARE other ways to employ effective people and give everyone correct working conditions. Well, he owns his bussiness and he made a decision

How did the 3 non-smokers get on before the Smoking ban I wonder? They obviously thought the balance of power had shifted due to the new legislation and that they could get away with immature threats. Dumb, dumb, dumb. Hardly surprised they got sacked.
Its not smart though to require your employees to smoke, I mean what if one decides to give up smoking? Do they lose thier job? Is there compensation for this in the employment contract?
What if his employees develop smoking related illnesses, is he liable for associated costs? Even proportionally liable?
Too big a mine field for me. Good luck to him defending that position.

Yeah, good points. I guess if one of them gives up smoking, they face the same decision: Either don't kick up a fuss about it or find another job. But yes, he'll need to word his employment contracts very carefully so as not to imply that you MUST smoke in order to work there, amongst loads of other disclaimers
