Thanks for the advice. Ill just keep returning the phone untill they get me one that works. Ill just go to a different link, maybe the staff will be a bit more helpfull.
I didnt want my money back because i dont like the phone, just that its faulty and was going to wait for a while for the problems to be sorted.

e.g. If you buy a T610 which hisses, and the retailer is unable to offer you a working model, they are obliged to offer you a refund, if you refuse an alternative. Although there is no obligation placed on the network in this case, they usually adopt the common-sense approach (for once!) and agree to terminate the upgrade and extended commitment.
T-Mobile, in fact, now offer no 14-day return on new connections either, as of a couple of weeks ago. Don't know how this gets round the 14-day cooling-off period but I presume they do.
However, don't in any way let this prejudice the fact that The Link are still a bunch of sheisters and should be avoided like the plague (or would SARS be more current?!)

Orange Direct allow you seven days to return the phone if you change your mind on an upgrade - I believe this is due to it being mail order. If, however, the phone develops a fault within 28 days then they will give you a full refund as happened to me - this is due to your statutory rights, especially if they can't replace it with a fully-working model. As they're statutory, even The Link is bound by them. I would kick up a fuss in front of lots of customers to see if the prospect of losing potential sales will spur them into abiding by the law.

IMHO The contract doesn't matter as your rights as a consumer under the sales of goods act take precedent. As the goods were not fit to be sold the contract is null and void.

Update for anyone interested or for anyone in the same situation.
Thanks for the advice as well.
They have said if i go back in on Monday they will give me a full refund, Monday because it will take Vodafone a day to cancel my upgraded contract and all that. Apparently.
But only after him and his manager denied all knowledge of the problem. Wanting to know why SE would release a phone with such a problem. Said they couldnt hear anything like a hissing when testing the phone, telling me it was a feature to enhace sound quality(ha!) and then saying its just normall background noise you get with all phones.
So they finally agree to give me a refund if Vodafone agree. 5 mins on the phone to Voda and they ask me to come back on Monday.
If they dont try to pull a fast one on Monday then ill be off to Carphone Warehouse to get an unbranded T610

its ture, u cannot demand a refund on an upgrade (where the phone perfectly works) Though some companies offer some form of leeway if u are aprized customer..
however, your problem is a FAULTY PHONE.. and that has to be replaced with a WORKING ONE soon, or if they cannot replace it.. then an alternative, or a refund, if u dont liek the alternative.

what is it with people on here that seem to slag all phone shops off.. i've been on this forum for less than a week, and people have slagged off phone4u, cpw, the link, and all of the networks as far as i can tell... if you are so bothered, set up your own network & shop and see how much money you will make if you keep refunding, when an exchange will solve the problem if the stock is ok..
rant over, i find that the link is one of the best shops around, and if you whinge enough, you'll get a replacement that doesn't hiss, and also compensation.. (keep whinging, half price bluetooth hands free, its DSG.. i know what they are like!)

But when you have had some jumped up little prat, telling you that they can not or will not do anything for you, when they fought over each other to be the one to sell the said item to you, then there comes a time when all bets are off, and it is time to get dirty. We are only after the same service when there is a problem, as we got when we wanted to hand over money.

i've had plenty of experience, in the past 6 years, i've purchased 14 phones and know exactly what its all like. I work with technology (all i'm saying) and some manafacturers have certian policies with good and services, so if vodafone say they don't refund upgrades, maybe that is what they do, surley that is a time to slag of vodafone, not the retail outlet that you purchased it from. I'm 99% sure that if the T610 was purchased from a voda shop, the individual would have slagged of vodafone generally, rather than a retail outlet that THEY CHOSE TO BUY A PHONE FROM.
i've had plenty of experiences with places like these, and i know the best thing to do, accept their policy, but whinge like mad, and most of the time (if you do it in a polite manner that is) they'll always offer something in the way of compensation.
its not the store that is really at fault, its the original policy maker, so in this case, vodafone!
