People are often selling stuff on ebay which is just information on how to get this or that cheaper.

he is not on-selling the service or any of the intellectual property of that service, he is merely attempting to make money from the fact that he found something which (presumably) not many people know about and they would be buying that information only.

Think about it. 'In the real world' as you just said... said 'agents nand middlemen' do NOT operate without some form of agreement with the service provider ie the MMS Server.
