From what I understand, it's not the process of Ogg encoding that is causing the problem. It's the fact that the EU is looking at introducing Patent regulations which mean that for each piece of software a company produces (and therefore presumably each version of said software), it must take out a patent. There is a bit of an issue with this (http://www.theregister.co.uk/content/67/32897.html) as lots of small companies dont have the legal knowledge to do this and also can't afford to do it as often as they'd need to in order to keep their product patents up to date.
