ask the person you're talking to and set on mute, that way the person you're talking to, won't hear those beeps, after activating the voice recorder, turn off mute.

one tip is to place "Sound Recorder" on your quick-links page (the one that uses right-joystick.. pink-icon in the main-menu)..

then when youre talking to someone, just press and hold your joystick to the left and your recording.. works like a charm

You don't have to have read anything for it to be illegal. "Ignorance of the law is no excuse."

In Canada, US and most of Europe is illegal to record a phone conversation without consent of all parties.

I know it's slightly off-topic, but my employer (and all the other investment banks) is legally required to record all telephone conversations, and there's certainly no warning of it when you ring up from outside.

Whether you're supposed to know that because you're phoning an investment bank it's always recorded, I don't know.
