the limit is not actually 3k. i have the same prob on my t310 but that problem only seems to be happenin when i try to download from certin websites.
i can download a mophun game with 40+kb so i dont see why i cant download a ringtone thats 6kb
any other suggestions besides network? and anyway to correct it beside network
(my network's not very helpful customer care wise, if u know what i mean
)

It's the WAP gateway (IP address in your WAP profile) which is run by your provider. Try to use a 3rd party public WAP gateway like wapdrive.com or waptunnel.com , if your wireless provider allows 3rd part gateways for your account.
