Someone will still have to pay for it... Either the buyer, or maybe the shop, or maybe the manufacturer. And it's none of them's fault.
And what if this "someone else that bought it" sends it to warranty and gets a reply that they could not fix it because it's not an original product ?
Besides that, the fake seller keeps your money.
...My opinion still is that you should look for another way of solving it.

I bought a fake one as well. I am in the US. The ebay seller is come_chinese007 or something like that. I placed a dispute about a month later after I received the headset. I thought the unit was just wasnt up to par with my Plantronics 590A so I just put it aside, not thinking anything about being fake until I saw a thread on howardforums.
As of now, I had filed a dispute with paypal, and they refunded me 100% of what I had paid in the transaction. And I still have the unit in my possession!
As for the person that asked about the difference in packaging, in my observation, ALL SE headset boxes have the large sticker on the side listing the product, product number and where manufactured. The fake ds970 did not have such sticker as you see in iaok's pictures you see one clearly. But again this is an assumption.

Well in short, I had put in a dispute to paypal stating that the unit was not a genuine item. The proof was the feedback the guy/girl has, stating that a lot of the headsets were indeed fake. I let the dispute go for 3 days or so and then after the third day, I escalated the case. In this instance, paypal takes over, emails both you and the seller to try to resolve and if the seller does not reply to paypal, then paypal judges based on the case in hand that you are correct. Time frame was about a week.
I am happy with the outcome.

Sorry for the late reply, but it was minus the shipping cost, I think it's the agreement when you buy something on ebay.

That just wrong. Just like another guy said, you were doing the same as selling the fake one. If I am the one bought your fake headset, and not knowing the return policy of that store, I might not return it, I will just think "Oh, SE fooked up again", and you are telling people here to doing that? FTW...
You should just delete or edit your post.

Wow i cant beleive all of you are soo quick to beleive everything is a fake. fake fake fake fake fake fake fake! its unbeleiveable. its really not worth anyones effort to reverse engineer the whole product from scratch and then get a factory to start producing it illegally when you can just goto the factory thats allready producing them and buy all of their duds that didnt pass the quality control maybe for small insignificant reasons and then selling them as brand new. now i do have a pair and they work absolutely fine with my k550i except of course the EQ settings dont seem to adjust the sound so i tried out my HT820s and had the same problem so i definately think it has to do with the phones firmware and nothing to do with my headphones being a fake. its annoying that for every small litle detail you are all soo quick to assume its a fake, and then ruin peoples reputation by giving bad feedback when theyve done little wrong. as for my headphones the sound quality is wonderful and THERE ARE NO FAKES, ONLY LOWER QUALITY SE PRODUCTS! not to mention the SE logo on my headphones look more legit than the SE logo on my k550i just going to show that small discrepancies in the logo DO NOT mean its a fake! JESUS H CHRIST you people...

Alexhaj: you should research more about the subject before saying this. There are many many fake products on the market... and people should be careful when buying this kind of product.

Are you going to tell me that sonyericsson made 2 different projects (one with high and another with low quality) ? Or will you agree that someone made a cheaper copy and tried to seel it as a sonyericsson ?
