In your opinion do you think Ebay could be liable under the trades description act for letting a seller gain trusted Power Seller status, and then rip loads of people off ?
Hmm, I honestly do not know what the answer to that is. I have never been a PS and wouldn't want to be one! I think the stock answer that ebay give is "ebay is just a venue" thus escaping any legal claims.

Secondly, Have you ever known Ebay or Paypal to Refund after their respective 60 day and 45 day deadlines have passed ?
I have not heard of a particular case but am sure that it may have happened. I think that would have to asked in the correct ebay forum and I do not have the knowledge or experience in those areas. there are community boards for an assortment of different subjects. I am a lowly ebayer with some years buying and selling experience and try to offer advice in areas that I am familiar with.

They are very interesting points and I wish that I was better qualified to give you decent answers!

By the way, there are now 73 group members and there was a suspected 'spy' attempt to join today. it is such a big operation and I personally check through every potential new member's history before they are allowed in!

Hi,
Has anyone else had this problem...

I phoned my bank today to report this as I had read that another victim had been able to claim the money back from their bank despite using a debit card and despite the sale being ages ago because they were concert tickets and the rules differ slightly.

My bank could find no record of the transaction!!!! At least not on the date that the money was meant to have been transferred and not for the amount that should have gone.

I checked my Paypal account and something doesn't quite add up as although darling Debbie does appear to have been paid, the same amount hasn't come from my own account although there does seem to be a record of a slightly lower amount coming out on the same day (Should have been £224.75 but seems to be £166.00).

All very odd but means the bank won't do anything! Great!

Did you have any money in your paypal account at the time? Paypal would have used that and then taken the remainder from your card.

Thank you very much again for your time and effort in answering my questions to the best of your knowledge.

I am going to seek some legal advice when I get a free moment... but Like you said, Ebay and Paypal seem to have themselves covered from all angles. But there is no harm in finding out if their defences can be Broken. Maybe then they will start to think twice about letting fraudulent sellers describe themselves as trusted.

I hope that you will keep us posted on here with relation to any further developments.

i think you need to read the previous 12 pages of this thread mate, the police are fully invloved, hope you get the money back, iv been scammed a couple of time and lost a few hundred

Hi all

Just wanted to say thanks to everyone, particulary Dixy and Pauline who have taken so much time and put in so much effort on our behalfs. I think I was the person who put the link to this site in the Ebay group arena and am glad that so many people have come aboard.

Hopefully things will be happening behind the scenes now for a while, but all the best to everyone and we shall hopefully see Ms Sheppard in court during 2008!!

I have to say I want to take a look, but feel a little bit hypocritical using an Ebay help forum when I am really angry with Ebay for not really wanting to help us.

I am sure Pauline is doing her best for all concerned... But I just have a nagging feeling Some Top Brass Ebay Guy's will be mingling in to try and defuse any public rebellion.

Am I being too paranoid??

You can also check Pauline out under her Ebay name "ilovebobbyo" - all is above board, as opposed to 'live-a-board' which is what that scamming cow is now doing on her most recent cruise trip funded by us!!
