see now I always over spend and they still gave no le way. i was already on O2 online 200.... they could have offered to put like £70 credit on to my O2 account and so effectively I'd have got the phone for free, but will have paid something then and nothing for a few months in contract terms.

You would need to work out a retention deal with o2 directly, come into the shop then I would do it as a free upgrade.
Also theres the question of where you are and where i am

yeah I was thinking the same thing... cheers guys for helping out!
I will respond with a follow up tomorrow, hopefully I don't have the same problem with the new phone.
