Did the auction state that the mobile was in mint condition or free from scratches? Just because something is brand new doesn't mean to say that it will not have scratches or marks. If the auction did say that the mobile was in mint condition or something to that effect then perhaps you cancomplain because you have not received what was advertised.

Notice that obvious large "chew" off the corner there. There are also noticable "wear" on the back battery cover, and a ding in the IrDA port as well. This phone is obviously not brand new.

I hate to quibble over minutae, but technically the mobile you bought could be brand new, the fact that it has scratches does not mean to say that it isn't new, just that the previous owner obviously didn't look after it too well.
If the auction did say that it was in 'perfect condition' then I would find out if you have grounds to complain to ebay. Is there some form of insurance for a situation where someone has bought something, but not received the exact product specified? The main problem that you will have is in proving that the scratches were caused by the chap who it to you and not yourself. Did the chap you bought it from have any pictures of it on display before you bought it? If so, did you save them? You might be able to use them to prove that it already had the scratches; of course that could be used against you in so far as the seller could say that you should have noticed any scratches present in the picture, but still, I think it would be worth a try. This is of course assuming that ebay actually have this 'appeal' function.
