I don't know where you're getting all this about being able to keep items that are sent to you in error, but you may want to look up sections 1 and 5(4) of the Theft Act 1968. With regards to you being over-charged, that is a Civil Law matter and doesn't give you the right to appropriate the phone for yourself, which you'll find is indeed a Criminal matter.

I would keep and use it untill they ask for it back, of couse by this time it would have been used it and have a few scratched marks. Then send that one back to them, and you still have a nice new one to use.

I wouldn't need to, I've already got one. And so has he. Had it since the day it came out and not a scratch on it. If I do damage it its insured anyway. Ultimately though thats just me and its his decision completely, but I was just stating that he doesn't have a legal right to it as someone had claimed.
