unfortunately that is not correct and I've researched this one extensively.

the taking of money does not make a contract. Indeed online sellers can determine when a transaction becomes a contract as long as they state it in their terms and conditions.

In the case of Apple their terms and conditions say

These terms and conditions together with your Order Confirmation constitute the Contract between us and you for the supply of Products and Services

so if you have received an order confirmation (which I did not) then you have a case otherwise tough luck I'm afraid
