We are intellectual property counsel to the site Esato.com. As you are well aware, Esato provides mobile-phone related services under the Esato name and service mark and owns and operates the website at http://www.esato.com. Our client's name, service mark and website are among its most valuable assets.
We have recently been made aware of your operation of one website http://www.mms3.com/gr_t68.php, that infringe our client's copy-rights in the Esato mark. Relevant information of your website are attached to the confirmation copy of this letter (Laffen: here you can include some of the logos and show them your text-string). We further understand that your website provides logos for SonyEricsson T68 mobile phones. Our client respects your right to do so--provided your websites do not contain any copied logos that are as a matter of fact, some other company's assets (and in this case, our client's). We must remind you that any such logos included on your website are actionable and can subject you to liability.
Regardless of your purported mission, your use of our client's T68 logos in connection with the operation of your website constitutes copy-right infringement. Quite simply, use of the Esato logos on your website in a commercial manner is a violation of our client's copy-right. It is quite evident from your website that you are profiting off of the Esato logos by offering them to the general public for a fee and using that particular section of your website to attract other customers to your company for your own commercial gain. For such infringement, you can be held liable for monetary damages, an injunction and our client's attorneys' fees.
On behalf of our client, we must insist that you immediately cease all further use of the Esato logos and remove the aforementioned part of your website. We further demand that you provide an accounting of the profits that you have received in connection with your operation of that particular section of your website.
Your swift and full cooperation would enable us to resolve this matter quickly and on an amicable basis. Please contact me as soon as possible, and no later than July xx, 2002, so that we may facilitate a prompt resolution of this matter.

This should scare them off a bit since it's a well-written and legally accurate letter. Other Esato users who have any legal expertise are welcomed to suggest any revisions or additions to the letter above. I really hope that Esato wins!!

Yeah, send the letter, i think it's a bit dumb of them to sell T68 logos, when Esato isn't the only place you can get them completely free.....

Finally found proof that they have downloaded the logos from the Esato site. It's a script located on their server.
http://web2.server1mms3.com/data/ericsson/new/
In this directory you'll find a script called "get_img.sh", which fetch all images from the Esato site.

Weird. I don't understand why go to such great lengths to steal images for a phone? They aren't that hard to make. You don't exactly need to sit there for hours just for perfection on one small image. If such a company needs to steal stuff like this and then charge people for it, I find that pathetic. I can't believe they are still going on with this (For about 9 months) and I hope any money they end up making all goes to Esato.
I usually and mostly make my own images, either with a scanner, digital camera or what I can find on the internet (Crop & resize),which turn out great. Quick and easy.
