appreciate your time!
with the SMP that doesnt pop up ,, but when I switched to SME, it started to occur...
any suggestions besides restarts...

Not sure what can be the reason, such problem was never before reported. I suggest you establish the exact conditions for reproducibility (when it always happens), then completely exit SME (must not run at all), try doing the same and see if the problem never occurs (this needs time!), then start again SME, and see if the problem re-occurs. In this way you can at least confirm that the problem is indeed caused by SME, and not something else that happened to your phone at largely the same time.
