Probably it is some proto, but why do they sell it officialy on auction system?
This is the biggest polish auction system and it looks that this is some company which sells a lot of phones there. They are getting into troubles selling this phone officially.
Maybe they bought it from somebody and they don't know it is f.e. "stolen" from factory?
I think we have to wait what happen next with this auction. Maybe I can ask these company about some details about this phone.

Then, in my opinion, the package seems to be official package for pre-released products, or presentation products (same as records for radio-stations that don't have the same jackets that mass records).
So I think if this shop got an official "press-released" phone, it was by legal way, so they are able to sell it if they want...

Well, as you know, SE proto always (or very often) have the "hang-on-off keys", while the final mass versions have "clear" & "back" keys.
