@cupcake. Nice photo but not a scene that will be different a minute later.
I'm afraid it's not valid.

.... what if it started to rain or clouds changed the lighting... I would tend to think this could have been a very meaningful moment for the artist with how the lighting comes through the trees and over the water. Even the OP has a picture of a guy fishing (he could have been there for hours) and a little girl day-dreaming on a fencepost (which likely lasted more than a minute)..... I would have to respectfully disagree and say that indeed cupcake's entry is valid based on the two aforementioned sample images.

nice pic either way --- thats just my .02

I appreciate the feedback, and with regards to whether the scene could change, it did, as a flock of birds flew by moments later and someone was about to walk by as I was taking photo, so moments later someone would have been in the frame or as mlife has said, the lighting could have changed, the whole scene kept changing as we walked along. I thought nature was the one thing that did changed constantly, and the photo captured the moment of our beautiful sunday walk

Surely the casting decision on the validity of a photo within a given theme should be cast by the person who created said theme since he/she has the clearest and intended interpretation.

I agree and I think hihihans was right to call into validity cupcake30's shot because that scene is showing no signs that it could change.

If that was the case then any photo would be valid. You could show a picture of the pyramids of Egypt and claim that a camel went racing by in the next moment.

Or you could show a calm blue sea and claim that a whale dived into the air and that would also be valid too. Personally, I don't think it's valid but I think the OP should decide as they know best.
