since you're asking...

as with most files of any type where copyright is involved, unless you own the copyright or have sought distribution rights for the files from the copyright owner, then it will not be legal unless the copyright has expired which in many countries is 50 years

copyright can be a complex topic but that puts it in simple terms

I have seen scripts for playing music on webpages. But it's damn annoying. When Im listening to music in my pc and browsing webpages then suddenly comes some music It makes me leave those pages.. So if you really want to have backgroundmusic on your page, then have it so people can choose to stop and play the music...
