Right sold a phone for £45+ £5 postage
they paid and i have snt phone this afternoon
then got this email
"Hi. We have a problem where an eBay user (*********) bided for the item I have won, increasing the price from £37 to £45, but then became unregistered. This effectively meant that someone not in the position to buy after bidding did so, thus inflating the price and costing me more money to win the bid (£8). (If you look at the bidding you?ll understand) I know this is not your fault but I'm led to believe by eBay that this may be a cause for a dispute, but in the first place I should contact you for a possible solution? To resolve the dispute straight away, would you be willing to refund the £8 difference (£8 being as they're were no more bids after this sum except myself). Else, I would seek a refund via the eBay & Paypal dispute scheme, of which I guess you could then re-list FOC or go for a second bid but that means inconvenience. Please could you respond with your thoughts before I progress this further with the disputes section."
Whats my position and whats his. can he claim money back ?

Hmmm
Kinda hard to tell...
Anyway, if his bid got high, it's only because he was in position to accept that bid.
The "disappearing" bidder could either be you (in order to get more money) or himself (in order to lower the final price, after getting other bidders not to bid since the price was higher).
So. Basically it's not your fault. You should stick with the final price.

if it was me? then i wouldnt offer a refund of £8 (maybe less - meet in the middle) as he could of caused this i.e: he could of been the other bidder, then unregister etc....... this could easy be a scamming way to get more money by you, or a scamming way to get it for cheaper the other person. i would offer a meet in the middle and give him/her £4 back, but as far as im concerned i dont think you 'have ' to do anything, you just need to consider your rating i guess.
tough one!

im almost certain nothing can happen to you so youre within your right to stick to your guns, but if your feeling atall generious then i'd offer to meet him half way.. then both partys are happy - if he says that aint good enough - tell him, chance gone - pay the full price......!

don't pay the money mate, that user id looks genuine, he/she bought something yesterday and transaction went through perfectly.
just pure coincidence that they are no longer registered, the buyer who bought your phone put his max bid in, he should have been prepared to pay whatever it went to as he bid to buy not to try and get money off.
stick with it and see what he does next.
