@Jag: I think it is safe to assume, if a person has not WEP encrypted his wifi network, he wants it to be a public network.

in the early days of wifi people called this
war driving and I have to admit I still do it now when walking around the cities with my k-jam
its just a bit of fun but much rarer these days to find an unsecure network you can actually connect through

War Driving is looking for a network, War Chalking is placing a chalk mark outside the building to denote there is an unsecured network there.
And YES this IS highly illegal. If you get caught, you will get fined or a possible jail sentence. It falls under the computer misuse act as 'unauthorised access'.

Only if you do it, though. Its not illegal if you don't. I think we need to take it in perspective

How can they catch you anyways??? they can only detect ur connection.... unless ur wifi user name is ur laptop/device serial No. then it is possible to catch you with ur detail of purchase that goes along with the serial No. other than that it is really safe....

My wifi hasnt got a WEP key, just havnt got around to setting 1 up, and im not actually sure how to do it lol. So if any1 wants to PM me how to do it that would be great.
I think if you use it sometime then the person will be non the wiser.
