my boss at work used my account to but an item. we contacted them through my ebay, their email, and he emailed them. 3 times in the same day we bought the item. They said they accept payments via credit card over the phone and if you wish to do that, send them the phone number and they will call. We did, no response. it happened for about a week, and today i mailed them and told them we got the item elsewhere and we need to cancel it. they said in the auction the item will ship within 24-48 hours, and would contact us the same day. never did.
so i want to cancel it, but they said no. I messeged them today telling them i wanted to cancel it (as i said above), and they actually wrote me back nearly right away. they wouldnt write me back any other time, until i said this. I messaged them atleast 10 times, and emailed. so i was left in the dark. now im going to get a bad reference.
is there any way i can fight this?

if they dont state in their auction about a set time to deliver teh item... then i think ebay has a standard, look into this.... but generally if you tell ebay about it, i think youre in teh right..... if they are taking over a week to actknowledge your emails then they may have broken the contract..... generally i think its 3 days from the end of the auction the buyer and seller must have contact... otherwise i think the auction can be cancelled... id personally get straight on to ebay.. tell them everythinga nd even tell the seller that youve done it (he/she might offer a cancilation if they feel your serious)
