Panda Software revealed this week the existence of a web site offering to build CUSTOM VIRUSES for $990 each complete with tech support. One of the benefits touted is the ability of the viruses to morph themselves to avoid detection by anti-virus software.This may be the first instance of commercially available custom made viruses ever.

yes of course it is illegle but the problem with such sites is that if shut down they simply move on and set up somewhere else.

Creating viruses is not illegal, nor is selling them if you exploit a couple of legal loopholes. Using them to deliberately cause damage or releasing malicious software into the wild is illegal.
For example, quite a few of the larger corporations use keyloggers to spy on their employees who they suspect might be using their work PCs for non-work related activities or who they suspect might be defrauding or harming the company in some way. They pay their IT guys to create and deploy the keyloggers on the target machines, it's all above board.
If the IT guys started releasing the key loggers into the wild and using them to get credit card info etc. then it would of course be considered illegal.
