just been upto cpw today to cancel my 12 month contract on my k800, i have been told that i can not cancel my contract if the handset is 100% fully functioning???
before siging the contract i asked if i could cancel the contract if i wasn't happy with the handset within the 14day cacelation period and the sales may (who i spoke to today) told me that is fine????

where do i stand with this issue, i thought by law the genral public had a time period to opt out of any legaly binding contract???

If anyone has a O2 contract, you can cancel now penalty free. This is what you must do:

Write a simple letter to their disconnections department (USE ROYAL MAIL RECORDED DELIVERY)

Write in your letter that because O2 has changed your terms and conditions using charging for ringing 07744 & 07755 numbers that this put`s you at a disadvantage under clause 8.4 c of your terms.

At the moment O2 let you ring 07744 & 07755 numbers out of your free x minutes, but from the 1st July they will charge you 25p a minute.

This is your get out of contract free.

CPW gives you a 14 day cancellation period to cancel your contract, so if you're within your 14 day period, you should be able to cancel your contract.

I don't know who you've been talking to, but every mobile operator and store gives a 7-14 day cooling off period to the customer if they want to change their mind and cancel the contract.

If i was you, I would demand to speak to a manager of CPW and get the contract cancelled, also prior to doing this, i would actually read the small print of the contract, and see how many "cooling off days" are available for you to cancel.

@karl.othen, that exact same thing happened to me a couple of months ago at CPW. I spoke to the manager who first tried to get me to take another phone but then happily told the salesperson to book it in as faulty and my contract was cancelled

ive had a similar problem with phons4u- slightly different circumstances, but they were playing harball. Best just to get through to a complaints/CS department and ask to speak to a manager. Explain the situation and tell them you are writing to trading standards and are looking for their input.

They are persistant buggers but you're absolutely right, all consumer agreements that require the signing a contract have a seven day cooling off period as part of your statutory rights. If you went over the seven day limit, the company is not obliged to cancel the contract even if some pleb of a salesperson did tell you that they would.

I agree, threaten them with trading standards if necessary!

Never sign up with a contract with the CPW in the store. I learnt my lesson. I signed up for a samsung d600 contract with carphonewarehouse. 3 days later i go into the store and say i want to cancel it, the contract was on o2 cpw. I got told i could not cancel it, i asked what about the 14 day cooling off period? I got told that vodafone and o2 cpw do not offer a cooling off period and basically am stuck in the contract. I said i didn't get told i couldn't cancel by the sales person in CPW. The manager said to me, that its something that the buyer should ask, i.e me, and its not upto CPW sales person to tell me i can cancel or cannot cancel in 14 days.

Manager said to me, only option is, to sell the phone if i want, and re-coup my line rental. Thats wot i did, but never sign up for them again.

if they turn out to be a complete bunch of ass holes, could i reduce my k800 contract to lets say £10 data tarrif, sell the phone then pay off the remaining 11 x £10 payments..... if done this way i would have the last laugh as i would actualy make money out of them as i could get £200+ for the phone on ebay

after being told "i can't cancel your contract sir!" 7 times, on the 8th he canceld my contract on the grounds that i was miss sold a mobile phone due to the fact that i was told i could cancel my contract within 14days by a sales member.

can't cancel the contract my ass!!!!

now i'm off to phone orange to get my
free picture messages
200 x network minutes (any time)
500 texts
and there usual bogof cinema tickets every week

for a monthly sum of £19!!!! happy days
