TVNZ wins right to screen full Rainbow Warrior trial tapes

TVNZ has seen off the final legal challenge by French spies Alain Mafart and Dominique Prieur to prevent screening of their guilty pleas to the manslaughter of Fernando Pereira.

TVNZ had fought a 20-year battle to get the court tapes and the French fought at every turn, TVNZ's head of news and current affairs Bill Ralston said.

TVNZ would screen the tapes on its Sunday current affairs programme this week after the Supreme Court today dismissed an application for leave to appeal from the agents. TVNZ was awarded $2500 costs.

In August, three Appeal Court judges gave TVNZ permission to show the footage of the agents pleading guilty in the High Court trial that followed the 1985 Rainbow Warrior bombing.

Some of the footage was screened on TV One at the time but a plan to screen extended footage on the Sunday programme was halted by court action.

Mr Ralston said TVNZ fought to screen the tapes because "it was an important issue for the preservation of New Zealand history".

He said work would have to be done on the tapes to restore them and put them on a modern format.

"In circumstances that it is hard to imagine ever being repeated in this country, the appellants pleaded guilty to manslaughter in 1985," the Supreme Court said.

The agents proposed to argue that the Court of Appeal failed to weigh their privacy against the freedom of information interests championed by TVNZ.

"We have not been satisfied that this is a proper case to be heard by this court," the Supreme Court judgment concluded.

"This is a very unusual case, which, an appeal on the merits having been heard and determined in the Court of Appeal, no longer raises any question of general or public importance."

During the Court of Appeal hearing lawyers for the French spies argued they never approved the closed circuit television footage being kept as a permanent record.

The Rainbow Warrior was bombed in Auckland Harbour on July 11, 1985, killing Mr Pereira.

It was later revealed France's then-president Francois Mitterand personally authorised the attack on a ship that had led the Greenpeace campaign against French nuclear tests on Mururoa Atoll.

The agents have since written books in which they described the experience of going up in court, and neither said it was humiliating or debasing.

The videotape was initially supposed to play on TVNZ during a documentary on the 20th anniversary of the bombing of last year.

In this one we have an innocent life lost, a Government sponsored team of bombers, a race across the pacific to track the spies, an international cover-up and high level resignations!

And it's all true!

Unfortunately I can't link it to GWB though...

Well the \"unproven one\" as you call it is much more widely known...i doubt something like this which no one has ever heard off as any appeal,proven or otherwise.

Im sure if you look hard enough in this you may find a GWB connection!

Well I guess that Europe might be able to sweep it under the carpet, but when your 13yrs old and your parents take you down to the wharf to look at the wreck of New Zealands only ever terrorist bombing, it kinda sticks in the mind for a while.

Londoners during 7/7 will know what I mean.

i remember it well its a very famous case. even before it came out that the french goverment were invovled.
in fact i think the french prime minster had to resign over it. its one of the first proven conspiracy theories which is probably why conspiracy theorists dont talk about it as its been proven.

Yawn..not much point discussing something that was pretty clear from the start and in which the guilty have been tried in court and sentenced. Nothing was covered up , no evidence hidden,lost or destroyed and no evidence of a conspiracy. Just a tragic loss of life and the guilty tried and sentenced in accordance with the law.

i ll take it from your comments that your not aware of the story, due to comments like nothing was covered up. it was a huge event a european goverment giving orders to attack a greenpeace boat that was pprotesting against the french testing.
it was attempted to be covered up but in situations like this were lives are lost people are more willing to cooperate

There was alot covered up actually.

The crew of the Ouvea yatch were only held for 24 hours as the Australian Govt (Norfolk Island is a territory of Aust.) wouldn't cooperate further. The yacht then disappeared somewhere in the Pacific. When I say disappeared, I don't mean we don't know which port they went to.

I mean they scuttled the yacht and were probably picked up by French Navy Submarine.

The admissions by French Government officials only came because a certain French newspaper decided to do it's own investigative work on the case. The New Zealand Police were stonewalled at every turn in thier overseas investigation.

It's the price of being Nuclear Free I guess.

Edit: BTW, not all the guilty have been tried in court. Only 2 of a possible team of 12-15 people were caught and those 2 were only lookouts not the actual bombers, certainly not the planners in France. _________________
