I'm very new to selling on ebay so i need a little help with something

I recently auctioned off a pair of shoes on ebay....unfortunately the winner buyer is one of those new members with 0 feedback score so i'm afraid i might have a non-paying buyer on my hands.
Its now been more than 36 hours since the auction ended and i have received no communication/payment from the buyer.
I sent a message to the second highest bidder and he's interested in buying if offered a second chance offer.

I want to sell off the shoes quickly to the second highest bidder as i dont wanna lose a buyer and again go through the entire process of relisting etc.
Now as i understand i cant file a unpaid item dispute before 7 days to recover selling fees however i dont mind paying the selling fees again for the time being but the question is if i sell off the item and then suddenly the winning bidder decides to buy them (to whom then i'll obviously have to refuse) can i be held liable for anything?
Also can i still give the second highest bidder a second chance offer if i have dont have multiple quantities listed in the auction.
If the winning bidder continues to be non-responsive then i will recover my selling fees, right?
How much time does ebay give a buyer to respond after i file an unpaid item dispute?

Any other suggestions/advice about what i should do?

PS: I will in any case give the winning buyer 3 days since auction-end to communicate before deciding to do anything else. Will also be sending a polite payment reminder tonight.

I don't think you can be held in any bad light for offering it to the next bidder, if you're getting no response your emails then that's poor communication from buyer. you've obviiously attempted to communicate. if you raise unpaid after 7 days you can close quite quickly by stating you no longer wish to communicate with buyer

These are my tips to you for future eBaying-

Make it clear in your discription in what time period you expect payment. I notice that a lot of traders say seven days but I feel 3 days is nearer the mark. This 3 day period allows for those buyers who use their work computer (leave Friday afternoon back Monday morning) to get back to you with payment.

Use PayPal and where you offer a "Buy it now" ask for immediate payment. Let's face it, you woudn't go into a shop to buy something and then come back days later to pay - You purchase - You pay!

ALWAYS state you will accept PayPal payments from CONFIRMED & VERIFIED accounts only - this will save you grief later on!

There are those out there who have just joined eBay and therefore have a zero feedback rating. Everyone has to start somewhere - If you are not happy though, ask those with "less than five" feedback score to contact you prior to bidding. If you want this to happen automatically, see your eBay preferences where you can "strick out" those you do not want to bid.

With very, very, very few exceptions try not to deal with anyone with a non-paying bidder marker (once bitten, twice shy!).

If you have time, particually if you have a high bid item, try to check your bidders feedback score looking for previous problems. If you are not happy, you can delete them from the bidding process.

If you are going to make a decent job of it, make sure your terms are clear to all possible bidders, particually if you will only sell to the UK only - make this clear otherwise you will get emails from all over the world asking for the cost of postage but DON'T make the other mistake of putting up pages and pages of terms - it's boring and (in most cases) not necessary.

Look at other traders, look at their wording and terms and adapt to your own site. Above all, as well as making a few bob have a bit of fun. Until recently due to other work commitments, I always tried to throw in the odd joke or two!

Thanks for all the replies.
Just a couple of things.....

1) If i sell it to the next highest biddder and then suddenly the winning bidder decides to communicate can he/she give me a negative feeedback?

2) Even if i do mention that i expect payment within 3 days in selling terms there is nothing i can do to avoid a similar situation can i?

If they leave negative feedback just reply to it stating that you have said here and it will show in your profile
