Okay so I purchased a k800i sim free on o2 for £220 over a month ago, probably longer.
Now it has just stopped working. I woke up last saturday and it was turned off (I never leave it with low batt overnight) so I charged it and then once it had finished turned it back on. It then continued 'searching' for about twenty minutes and was really slow to react to any buttons being pressed. So I turned it off and removed the sim and battery then tried to start it back up but it now won't even turn back on.
I phoned up o2 and turns out it is under their warranty so they want me to return it recorded delivery and they'll ship out a 'refurbished' handset when they recieve mine. Now I didn't pay £220 for a brand new phone and keep it in pristine condition (apart from the buttons peeling off, which isn't my fault) to recieve a refurbished handset which could have scratches on it. It's not as if this is my fault that the phone won't work.
Now I know it came with a guarantee from SE for 2 years but the guy at o2 suggested they would only deal with something if it was a mass problem with the phones. Does anyone know if I should return it to SE and they will send me a new one or how is the best way to deal with this problem of a refurbished handset through O2.

If you return it to SE they will repair it, unless it is unrepairable. Normally O2 would send it away for repair too if it is over 1 month old. If it is less than 1 month old then you can damand a replacement.

Sadly under the terms of the warranty from O2 they will only give you a refurbished handset. All networks are like that but sometimes you cannot tell if its refurbished.
The only way O2 will give you a brand new handset is if you take out their gold insurance plan. Under that you are guaranteed a brand new (fully boxed) handset. Sadly this will cost you about £8 per month!
A service center might be able to fix it for you but SE won't take the handset back. They will just tell you to go through your network operator under the warranty.

I would rather that o2 repair it rather than send me another phone that I do not know the condition of. As the buttons are peeling I would hope they would repair those too.
To be honest it's a bit of a poor service when you pay so much for a phone and it stops working due to a munafacturing fault that they send you another phone. Although I suppose it is the same case with ipods too.

Out of interest what would happen in a years time if the phone brakes as it will still be under the SE 2 yr warranty but not the o2 one year warranty. who would repair it then?

To flash download the update service software

Remove your sim and m2 card (if you have one) replace the battery but don't try and turn on (which I know you can't anyway)
start the update service software and follow the on screen prompts,
(you basically press and hold down key 'C' while doing this you connect the USB cable)

Ring Sony Ericsson customer services & ask them for the details of the warranty returns procedure & where to send the handset.
Send it by SPECIAL DELIVERY & let SE fix it.

Some CPW's act as SE service points if you take in proof of purchase-might be worth checkin there website to see if one of your local stores is equiped to help you!
