I just cancelled my T-mobile contract about 2 months ago on my W800i. As part of this I asked for the unlock code about 3 weeks before my contract was up. They charged me the £15 pounds to do this about 2 days after I called.
Early October I called them to ask what was going on with it. I was then told the IMEI number they had on file was incomplete. This was a number they had not a number I gave them. I then confirmed my actual IMEI number and they said it would be another 20 working days.
What are my rights now that the phone is not able to be used as intented as I cannot use another sim card with it? As far as I'm aware this phone is now mine since I have completed my contract. Can I demand a new unlocked phone or do I have to wait? I think this is against my rights and the phone is not able to be used for the purpose intended. Any consumer laws that cover this?

In theory if they have taken your money to provide a service (to supply an unlock code) then they have an obligation to supply the service or give you your money back.

Thanks for the reply, but are they not obligated to supply me with the unlock code regardless as it is mine to do what I see fit with it?

shouldnt the phone be unlocked already if its contract my k750i has had a t-mobile contract sim , orange payg virgin payg. :?

The way the networks look at it is they supplied you with a highly subsidised prelocked handset originally and they have the legal right to lock it (as per the T&C's you signed when you connected). You are right in saying the handset is yours to do with as you wish-however, they also have the right to charge you an admin charge for supplying the unlock code, and your not entitled to demand a SIM free handset. I'm sure this was a genuine mistake on there part and will be resolved in a timely manner.

I do agree that they have a right to lock it and even charge a bit of money to get it unlocked, but it just seems that they are either stalling in hope that I will give up or they just don't care about customer service now that I am no longer a customer. I'm just glad my O2 W850i handset is unlocked.

Why would they stall? You have left-messing you around would actually cost them more than they are making. Sounds like they made an honest mistake. They're only obliged to fulfill your request and as money has changed hands it's contract law. Easy to sort out- speak to your local Trading Standards office

To be honest, i wouldn't be suprised if you get your letter through the post with the code and the sequence within 10days-unless there's a backlog! As for the K750i someone mentioned, they never launched the handset and therefore was most probably generic and by default SIM free anyway!

when i managed to block my n73 by putting in the code 3 times wrong then i rung up t-mobile gave them my number they asked for my password i told them it and then they gave me the unlock code , 100% free, but my n73 wasnt the phone i got origionally on comntract i just put the sim in it
