hi, does anybody know about a LAW that prohibits unlocking and upgrades... as i understand all you can loose is just your warranty...
any comments regarding this ??? anyone...:_)))

well no it shouldn't be illegal. i'm not sure though. after all, all you're doing is making the phone what it was when it was made. i'm guesiing if it was illegal to UNlock it, then it would be just as illegale to lock it.

I'm sure it's not illegal to unlock your phone because T-mobile has an Unlocking Department for their customer who wants to unlock their phones. I just used them more than 2 weeks ago and there is no charge.
Flashing is not illegal; however, it will void your warranty.
The only way it could be illegal is if you find a way to flash your phone with a hack firmware that would enable users to make free calls and not get billed. That's called Theft of Services.

None of the mentioned above are ilegal as such.
Unlocking your phone: (This is how it works in Norway, I can not speak for other contries).
What do you achive?
You get the ability to use your phone on another network than the one your phone has been tied down to.
Having a locked phone means you bought the phone with a sertain discount, meaning the networprovider paied a certain amount of the total price of the phone. You sign a contract where you agree to use the given networkprovider for a given periode of time, usually 12 months. By unlocking your phone you break that contract. If the networkprovider discover that the phone, identified throug the E-MEI, are used on another network they can lock the phone over the network and refuse to open it up untill you have paied the unlocking fee mentioned in the contract you signed when the phone was bought. (the two main networks in Norway charge 1500 Norwegian Kroner).
What else do you achive?
You get the privelige of paying for two subscriptions at the same time.
After the end of the contract time all you need to do is call up your network and cancel the subscription, free of charge.
Uprading the phone:
What do you achive?
By upgrading the phone yourself you can get the latest SW without giving your phone to someone else. In some places you avoid having to send it away and being without your phone for a few days.
You will lose the warranty on your phone and the chances of sitting with a foulty phone are dramatically incresed.
By letting a

SP do the lob you will get the latest SW for free, some SPs do charge if the phone is bought elsewhere. If anything should go wrond during the upgrade the SP are resposnible for it and will have to refund you for the damage. (New phone) Chanses for an official upgrade going wrong are very slim thoug.
This is what I managed to dig out when this was brought up some time back and it is what goes for Norway. I suspect this counts for a few other areas as well.
