I got a problem here.
I sold my faulty Nokia 8800 on ebay and stated no refunds or returns... But now the guy has opened a dispute and paypal are holding £145 of my money!!
He started this dispute just because the IMEI on the phone and box did not match. Can he do this??
If he wins im screwed!

Just tell them that, that you stated clearly no refunds! Bet he's arguing over silly little points as an excuse to get the money back as the fault isn't as he thought it was or something. He could be clutching at straws, hopefully Paypal will see that and give you your money back.
You have my sympathy, I got shafted just before Christmas by someone who I sold a phone to back in August but a chargeback claim in claiming their card had been used fraudulently... and as I shipped to an unconfirmed Paypal address/account I lost £80!
Let us know what happens!

Hi Ridahz,
I've just won a case at Paypal and got my money refund, see
HERE.
I know it's completely different but from my experience all I can tell you is that Paypal works with clear and evidenc proofs, support documents, etc.
It's up to you to submit them and call afterwards to explain once again.
You need first to read and analyze everything what was stated in your advertisement, and if there are ambiguous terms you should make sure to explain them when calling Paypal.
There is normally no reason for the buyer to refuse to pay because of the IMEI number difference. Were you selling a phone or an IMEI number ?
Did you wrote provided in its
original package ??? That can be a point for him !!! But even if he can say that, he has to return the phone.
I heard that lot of people are trying to steel others like that by claiming to Paypal, but stay confident and take time to collect all details for your case.
The employees of Paypal have good sense and if you're in your rights you will win the case.

WOW,
Man that guy is really a thief, and if I was you will not let him go like that.
1) Reply to the claim by explaining the content of your ad. Insist on the fact that nowhere it was said the phone IMEI number should be on the package, and that it was not even mentioned that he will get the device in its original box.
2) Call Paypal again to explain everything verbally and ask them their fax number for you to send them a copy of the ad.
3) Print out your advertisement and fax it to Paypal, together with a short note saying also that you don't want the phone back as he may have done whatever with it : you want that money.
4) Enter a claim at Ebay against the guy as material not paid.
5) If after 3-4 days you don't get any confirmation via Email from Paypal as they've received your fax, call them again.
Man don't give him time, he's a pro a don't even ask for recuperating your device.

Paypal useless ? That's definitely not my opinion mate.
Three times I've entered a claim for reimbursement en three times I won.
And Paypal has always been fair as I was in my rights.
There are lots of small telecom centers where you can fax though.
