If a brand new phone does not work as it is supposed to you ought to take it back to the shop where you purchased it. SE need to know. The shop are obliged to report it so SE knows whether a whole series of the production line have a defect.

I have r5c001 - i just want to be sure that it is not a hardware problem - the problem in my country is that there is no place where i can upgrade my software - i haev been reading other post and this freezing appears to be a common issue.
do u think it is a defect in the phone or is it just something that is 'normal' for the phone

The normal behavior of a T68 is trouble free! Take it back to where you bought it. The warranty will cover it. If they can't fix it they should give you a new phone.

thanks for your help yet the problem is this - if i take it back he will give me another one which most likely will do the saem - as from what i have read in the forum many others have the same problem - and if it is sent back to ericsson it will take me two months to get it back
The Freeze i found out occurs mainly when i pres the no button repeatedly very fast.
I read somewhere that master reset can solve the problem is it worth trying

Do that, a master reset does no harm to your phone. The drawback is that you lose everything you have stored in it. So, before you do a master reset I recommend you do a backup.

I can't guarantie that it will solve your problem. You need a backup cable and follow the instructions in the CD that came with the phone. It's quite easy.
