Randomly browsing ebay when I find this - no info regarding weather it is a proto, although I would guess it is (always the possiblity of a scam though)

Yeah, there's a good chance. Look on the picture of it, it says "*3 units bought you will have another one for free" - Not just is it in broken english, it is suggesting they have at least four n95 8gb to sell
