i fully charged my k800i before i sleep., and when i woke up the battery is around 10%-15% and the phone is warm...it happened on me twice but since i'm here in the philippines where technology is poor i dont think that this is happening in my country.,

I hope nobody believes that! If somebody believes this, please contact your neirest software/hardware engineers. As the second video suggests, for this to work, some special hacking is needed. It cannot be done with any phone...

Exactly. An unmodified (ie: stock) handset cannot communicate with the radio network while turned off, nor can the mike operate. So it's effectively impossible for an ummodified phone to do this.
Someone would need to access your phone, or you would have to download the moddified firmware inadvertanly while doing a SEUS or FOTA update. It's quite unlikely that the operator (depending on country) would be prepared to sacrifice their customer's privacy by allowing this kind of update unless they had a court order. Such a court order would be hard to get unless there was evidence you involved in some pretty major criminal activity, and in many countries this kind of court order would actually be illegal.
