Vodafone has won an injunction preventing T-Mobile from selling the iPhone in Germany. T-Mobile is Apple's exclusive carrier partner in Europe's biggest market.
The lawsuit challenges T-Mobile's exclusivity arrangement with Apple. There's some confusion about the extent of the injunction - with Dow Jones reporting a total ban on sales as a consequence of the Hamburg court's decision, while other news services suggest that sales can proceed if the iPhone is available SIM-free.
Vodafone's German boss Friedrich Joussen denied the goal was an outright iPhone ban: "We want it to be available to buyers without a mandatory calling plan. If I had wanted to halt sales, I could have, but I didn't," he said in a statement.
Under French law, Orange must offer a SIM-free version of the iPhone alongside one tied to a contract.
Vodafone's lawsuit is a significant challenge to Apple's go-to-market strategy, and therefore the business model it has devised for the iPhone. Apple takes the traditional network operator's subsidy, but doesn't use it to subsidise the phone. The company has also demanded a share of revenues generated by the device.
In an interview published yesterday, Vodafone CEO Arun Sarin described the iPhone as "a pretty poor experience", and said his company insisted on the right to call the shots.
"Whoever comes into the marketplace is going to have to work through us," he vowed.
Steve Jobs shouldn't take it personally, though. Network operators fight a constant battle to keep handset manufacturers with "cool" brands from setting the pace and negotiating a better price. For example, Orange's current line-up features no phones at all from either Nokia or Motorola. ®

T-Mobile is to start allowing German customers to buy Apple's iPhone without a contract to its network, as it moves to comply with a court injunction.
Its announcement comes after rival Vodafone went to a German court to challenge T-Mobile's exclusive tie-up with the iPhone in Germany.
T-Mobile will now sell people just the handset for 999 euros ($1,477; £719).
This is a significant premium over the 399-euro price for those who also take out a two-year T-Mobile contract.

if they do, they will probably sell it for £799, like T mobile have done. In the UK O2 have a bigger share than the market than Vodafone. However outside the UK i am sure that Vodafone have a bigger share of customers than O2/Telefonica combined.

in a magazine my mate brought back with him it's saying Vodafone is the largest, Voda do seem to have better handsets and 02 are seeing them as a threat at some case.
I actually prefer Vodafones services compared to 02,
02 are very primative to Voda thats my weeks experience anyway
if Vodafone do want to get there hands on the iPhone I don't think 02 will have a chance to keep it to themselves forever across here.

You got a link on this mate. My mom worked for AT&T and I got a "FREE" iPhone and want to get it unlocked.

What magazine is that? And when was that data collected, showing vodafone is bigger than O2? Since the statistics we have here at work, is that O2 are currently number one in market share in the UK. What better handsets would you say that Vodafone are brining out compared against O2? O2 will hold on to the Iphone for being the exclusive network partner in the UK for the ammount of years that they signed up to, in the deal with Apple. If they are to bring that handset sim free, then as I said before most likely it will be for £799.
