Hi, im with vodafone and they called me up about a week ago asking if i wanted an upgrade, i made a verbal agreement and recieved the phone the next day... the phone has been fun, but completly unpratical due to bugs... i phoned them up today asking for a exchance(which they said i could do free within 14 days) for the N95 8GB which they originally offered me(for free)... now they are saying they want £100 for the new phone!???
I am not the account holder, nor does the directdebit come from my account. I simpily use the phone and have access to the password for the account. I am wondering if i have any leg to stand on in cancelling my contract??? i have no signed anything, nor has anyone else...
any ideas what i should do?? i still want the N95 8GB...

Bug them on the phone till they give in! and if not then maybe go to trading standards or other organizations dealing with this matter.

lol they know its not in my name, the contact is in my mums name lol no fraud... they knew exactly who i was and exactly who the account holder is...

I can't understand this. If they knew you weren't the account holder than I don't see how they could have proceeded, or indeed why they would have.
Also, if you are under 18 (don't know if you are or not( it makes it even more strange. To be frank, in normal circumstances, it would be relatively easy to advise you what to do next . However, as the starting point for your query is one, that in theory at least, should not be possible, I can't see a way to help. Can you perhaps go into more detail on the exact circumstances of the call and the basis upon which the transaction took place?

Wasn't a Nokia E65 was it
btw you can cancel your contract within the 14 days.
I think you should call Vodafone back again and tell them you were offered a exchange for your previous buggy phone for as you requested a Nokia N95 8GB, as everytime you contact them your sent thru to a different advisor
