Under any legally binding contract if they are not providing goods under that contract that does not work then yes they should be able to give you an alternative without penalty. You see years ago i had a Vodafone contract and i had a very poor Motorola phone which was being sent back 6 times before i rang them and said i have had far too much trouble with this phone and i managed to talk them into giving me an alternative phone. I got the W900i for £50 quid. They were very good. Not sure how Orange will be but its worth a try and maybe Fatreg can answer this one.

the anoying hing with orange is that one person says something then the next doesnt have a clue at orange, for example i asked them about changing my modle and they said that they can only do that after it being the third handset sent out,
but i asked again with a different person and they said they can only send out the same phone. so u reckon i should say to them by law i am aloud a different phone and that they will be braking the law by not changing the modle?

DMR works on 2 levels... DMR being different model replacement...

if you have Orange care..

if you have had 3 different phones with the same fault you can express that you would like a different phone..

if you spend more than £100 a month per phone and have had 2 phones that do the same thing you can ask to change..
