Hi guys, i have a small problem and was hoping someone could give me a bit of an insight.
Right about 2 months or so ago (maybe a bit less) my CST-70 charger only 7months old stopped working, something was damaged, the pins were not bent so I assume that a cable within the charger was damaged.
Anyways it would charge the phone but with great difficulty, and i had to wiggle the cable about a bit to actually make the connection.
I decide to send off the charger for repair about 10 days ago after receiving a new CST-75 charger from play.com as i couldn't be left without one while the CST-70 went in for repair.
This morning i receive a letter from the SE repair center (Kuehne + Nagel Limited) stating that the charger is "out of warranty" but their never specified a reason despite there being two tick boxes namely
"phone is out of manufacturers warrantey period (not true as the phone isn't even a year old)"
and the second being "this type of repair is not covered by the manufacturer's warranty"
They pointed me to the SE website to find the warranty information but I couldn't find any regarding the CST-70 charger, and in the letter they have detailed that in order to get it fixed i will have to pay £11.64, and if i dont want it fixed but returned to me i have to pay them £10.
They have also stated in 28 days they will dispose of the charger if i do not reply.
My issue with this is that under the Sales of Goods Act 1979, a product has to be fit for its intended purpose and of a satisfactory quality.
Considering the purpose of the charger is to charge the phone and it does not do that, it fails one criteria.
And as far as satisfactory quality goes, if i am not mistaken it means the charger should work for a year period. The charger didn't even make it through a full 7months before the problem arose.
I'll also add that the fast port on my P1 is not damaged because the CST-75 charger works, as to my headphones, and USB cable.
What i would like to know is if i have a case against SE (well the repair centre at least) because I am not willing to pay them £10 - £12 for them to fix the damn thing when play.com offer a brand new CST-75 for £10.
However, under the manufacturers warranty shouldn't the damage be covered (well mechanical fault) for a period of a year? I've not used the charger on anything but my P1 and i haven't submerged it in water, or taken it apart. So i can't understand why they are claiming they are not entitled to fix it. As i said i couldn't find the warranty relating to the CST-70 specifically, and i'd just like to know what my options are now.
I'm going to also email SE support see what they say (although on my previous talk with them they said to send the charger at which point it will be put in for repairs). If however i fail to get anything out of SE support anyone got any suggestions?
To be honest with you lot, the £10 ain't and issue, i earn more than that in an hour of work so it is hardly something that bothers me. However, what does annoy me is the fact that the good is not fit for use, it is not the only problem i have had with the phone since owning it, many other members on the forum also have a number of problems with their SE products. And it annoys me that SE don't give a rats arse about it.
Oh well, just for comparison my Nokia 3510, had it since release not one fault with it, and it came out of my pocket while doing a wheelie, ended up skiding across tarmac for 20 or so metres and still works, the SE products I hate to wonder what will happen if you put them down on a table too hard especially since the charger destroys itself while sitting in my sock drawer lol.

from my understanding your charger should be covered under the warrenty of the phone as it was part of the boxed contents. Even if it was a seperate item it should still be covered as it is under 12 months old. I would call them and get them to explain why they wont fix it.

Well rang up the Kuehnu and Nagel Limited, they are shut on weekends so I will have to wait till Monday to find out what is going on.
I've emailed SE customer services we'll see what they say.

or was it the phone has a 12 months warrenty, but this doesnt include consumables eg battery, charger ect
but if i remember rightly most repairs centres just give you a new battery/charger if its gone faulty as its not worth the hassle.
but i left the phone industry a few years ago so this has prob changed since.....

well if it is a 6 month warranty then i cant really argue i guess, though to be on the safe side i'm gonna dust off my old consumer law books and have a nose around at sales of goods act 1979 because i'm pretty sure that the stipulation within the law states that a customers statutory right exists for a year period under the clause of satisfactory quality.
As i've said the £10 quid aint an issue, and the fact i have the CST-75 already means i can charge my phone. But still it pisses me off that my first attempt at an SE device has left me with an unpleasant taste in my mouth.
The phone is lovely, but little things like this annoy me. Ah well live and learn, but i'll ring them tomorrow and see what they say and i'm gonna have a browse see where the customer rights and laws leave me.

Had a quick flick through the 6 pages and found this little clause in their warranty
"3.This warranty does not cover any failure of the Product due
to normal tear and wear, or due to misuse, including but not limited
to use in other than the normal and customary manner, in accordance
with the Sony Ericsson instructions for use and maintenance of the
Product. Nor does this warranty cover any failure of the Product due
to accident, software or hardware modification or adjustment,
acts of God or damage resulting from liquid."

Well just rang up Kuehne Nagel, I spoke to a Gemma she also couldn't see why I was being charged so she hopefully will look into the matter and will get back to me.
But failing to do so, guess I'll have to ring them back...

Just thought i'd update, turns out that indeed the charger was under warranty and following my complaint to the the SE support email address and them forwarding the email to their "escalation" department the charger is being replaced under the warranty as it should be.
So there you have, if you think you are in the right, complain, and complain loudly.
