i've noticed that k800i does not recieve clock themes for some time but i keep wondering, not until i extracted a clock theme and found out that there is a flash file(swf) file inside so is there any upgrade that will correct this?

The themes contain swf files which is used by the phone to display it as mani menu...
K800 doesn't support swf files so flash themes cannot be used in that model...
P.S. Most walkmans have it...
