May be there is something wrong with your battery. I'm really surprised with my 995 battery. I charge it every 2 days.

Which firmware do you have? When i had this phone the latest firmware ends with 035 and battery life was fine. How long you had it? If its still within 28 days i would return it for exchange

it shouldn't be....i think you deserve a free replacement if it is still under warranty

Do I have to get a new phone or can I ask for a new battery?

Could be a faulty battery. Where did you get it from? Most stores now have a 28 day faulty exchange. Just tell them your battery runs flat too fast. But are you using it ALOT? I know some people at work who never give their phones a rest in any part of the day with constant use. They then moan the battery is dead too quick.

I listen to music everyday 40 minutes in the morning (headphones) and maybe 15 minutes more thourghout the day throught speakers.
Use the camera here and there but no photo montage just taking random shots
And I check Facebook on my browser now and then but it doesint take long
I got the phone from my carrier Cellcom on cantract.

Oh so it was distance selling on contract. You should still be within your rights though. Sounds like you dont constantly hammer your phone daily then. Could be a faulty battery. Also how is your network coverage? Do you have a decent signal at home? If you have poor signal that causes the phone to use more power and operate at a higher power.
