> Orange and faulty phones!

Can anyone offer any suggestions here?
I am having problems getting Orange to agree that my phone is faulty. I am on my second T610 with the same fault (Phone does not always ring on incoming calls - fails about 10% of the time).
They now say that the "fault" is just the way the phone works and replacing it will not help - therefore they will not give me a fault code - therefore the shop cannot exchange it.
All that I want is a properly working T610 that I can use! Is this too much to ask for?
ANy suggestions as to how I can proceed gratefully received.
(Current phone is 03W23 - R1A firmware R3C Hardware)
TIA

I had the same problem with the Orange shop when my

T610 started playing up. Bluetooth wouldn't keep a connection for more than 5 seconds. Orange shop gave me the same "need a fault code from Orange before we can change the handset". I also threatened to use my 7 day money back guarantee as the phone was only 3 days old. "You can't do that with upgrades Sir". The shop even said to my face before I bought the handset that you get a 7 day money back guarantee on upgrades, not the standard 14 days. Anyway, I ended up going to Sony/Ericsson direct who advised me the firmware needed upgrading. Got this done and the handset works fine now. Funny thing is that Orange phoned me back after the software upgrade with a fault code saying my handset WAS faulty. My opinion of Orange has gone down after this.
Come to think of it, I often get missed calls. I put it down to me not hearing it in the car or the phone being in another room. Maybe mine is not ringing all the time?
Oh dear

@miss_uk The phone is already an upgrade - that is part of the problem since there is no automatic replacement on upgraded phones!
@marksurry I had the previous phone upgraded - it got better but did not fix all the problems.
Oh well - looks like I am stuck with it
ANyone else any ideas?

If you complain long and hard enough, and to everyone concerned regularly you will often get what you want.
Dont give up so easily.

I am not giving up easily - I have been persuing this since the 9th August when I got the second phone.
Does anyone have any experience in invoking the Sale of Goods Act under circumstances like this? I cannot make out if the shop or Orange is liable.
I guess that one option is to return the phone and get something else. In that case - can anyone suggest a viable alternative to the T610.
Important items (almost in order!) are Bluetooth, GPRS, Java, Email, MMS. Less important is the camera
Thanks for all the input!

S55 is a viable alternative. Would suggest t68i but orange no longer sell it. Hunt for a member called jonbob on this forum. He might be able to help you.
