the reason why it might get shut down if eBay notice it is because he's selling copyrighted material without a license (i assume he has not got a license if he's selling for that price!)

strictly speaking, the cd media is of course not illegal it's just the data stored on it. But it still breaks eBay regulations. You can't put a DVD-R full on MP3s onto eBay, but you can put a blank DVD-r of course!
