What is the fault?
What have you tried?
My preference, for peace of mind, would be to return it to O2 and wait until January for a replacement.

problems with RF signal, SE service center advised hardware fault and advised return the phone.
o2 wont take the phone back till they have stock, which maybe after the 28days, any idea where i stand legally?? i know that the shop has to resolve the problem with faulty hardware within the first 28days

When I had a similar situation woth Orange, they noted the fact that I had reported the fault and obtained a fault code.
Then I waited until the shop had stock and went in and got it replaced.
Easy really
