If you are under contract directly with O2 UK (that is, not going through an airtime reseller like Carphone Warehouse) you currently have the opportunity to cancel your contract without paying any early termination penalty.

Why? Effective May 1, O2 are raising their international call charges. According the their pay monthly terms and conditions:

8.3 If this Agreement is ended during the Minimum Period, you must pay the monthly subscription charges up to the end of the Minimum Period. This does not apply if you end the Agreement for the reasons in paragraph 8.4.

8.4 You may end this Agreement at any time if:
(c) we increase any of the Charges for the elements of the Service you are using or change this Agreement to your disadvantage. In this situation paragraph 8.3 will not apply.

As the contract mentions "elements of the Service you are using", you will be eligible to terminate if you have made any international calls.

This is not speculation. This is fact. I have just successfully cancelled a contract myself. The customer service agent's initial skepticism was quickly quieted when I quoted paragraph 8.4(c) from my contract.

so if i was to sign up right now and get a free phone on a contract, dial an international number, pay the months bill i would be allowed to cancel my contract and keep the phone i just got for free at no extra charge?

This reminds me of T-Mobiles recent decision to allow early termination due to their changes over itemised billing charges. I took the opportunity to dump them, but it wasn't easy! The girl on the other end of the phone tried to pretend that she'd never heard of this get out clause and wanted to charge me £68, but I persuaded her in the end.

Typical big company attitude. They can do whatever they like, but if you're just one day late paying your bill, they come down on you like a ton of bricks

So the obvious question is which network to switch to if I cancel with O2?

@TheGlassJaw

Depends whether they've already changed the contract or not. What I mean is, if you went and got a phone on O2 right now, the contract may have already been changed to prevent you from terminating it without paying the penalty. It probably only applies to existing customers, as is what happend with T-Mobile.

Well it might be, but like I said, T-Mobile claimed to know nothing about the get out clause that I used when I rang them! It took a good 30 minutes before they agreed to waive the cancellation fee!

They may not charge you the new rates untill your 12 month contract runs out. The new charges may only apply to new customers. This message was posted from a T610
