A Waterloo man faces federal charges of having child pornography on a cell phone.
Prosecutors say it may be one of the first cases of its kind in Iowa.
Twenty-year-old Justin Van Dyke is charged with one count of possession of child pornography. According to the indictment filed this week, Van Dyke had child porn on his cell phone which had picture viewing and storing capabilities.
Assistant US Attorney Ian Thornhill says it's the first case he can recall. He declined further comment on the case.
A hearing is scheduled for August 26 in US District Court in Cedar Rapids.
The charge carries a sentence of up to ten years in prison and a $250,000 fine.

The guy was only 20, so even if he had a girlfriend that was 17, and they were her pictures, then it would still be counted as child pornography

What if it happened that the one caught is a family man, and have multiple 'nude' images of his kids, say aged 3-8, bathing in the comfort room
Images just taken for fun let's suppose here
. . . I guess in the very near future, there will be some laws implemented in various nations restricting the owners of celfones with cam with regards on the proper way of using/handling it

Even if the underage person agrees and there is no victim an adult can be held accountable with "statutory rape" and sentenced. Happened to an adult (30+)female teacher who had sex with a 14 year old. He like it, too. On their second offense she got canned for 7 years.
Sexual images of persons under 18 is a big no no. You are in trouble even if you have no clue how you got that stuff.
