> O2 Faults with k700i

After having my k700 for 6 months with the early firmware, It has started to develop a number of faults, ie numbers dissapearing, not sending texts and phone locking up in standby mode (clock on).
Called o2 about all this and they said I could have any phone which is free as a replacement, I asked if I could have another k700i and she replied that she could not confirm to me that the new k700i would be fault free.
My question is......
If I get a new K700i will it have the new firmware on it?
I think all the above faults will be fixed with this new firmware.
If not what other phone would you recomend?
