It sucks, I know themes were made to be shared but it's annoying when someone takes one of your themes and make it their own. It's not so much the site itself because they can't determine who the author is. It's the person who take someone elses themes and upload to a difference site as their own with no credit to the real author of the theme.
Here's a place that takes other peoples themes and selling it.

its a shame that people still steal themes.
people take a lot of time and effort for these themes to be made, many just for them to be leached.

Daylight robbery! There should be a way to take action against such people, though I can imagine the trouble it would be... Protecting intellectual property rights seems a little more difficult than other traditional works.

IP rights mean nothing if neither party loses anything financially, since that is the only reason why they exist. And the law is not going to start bothering protecting such simple cases considering that even the rights of musical artists and other people in the media industry are hardly protected.

try using DRM on your theme files. i think you can add tags to show you own the file when ppl look it up on there phone.
DRM also locks your files so ppl can't steal them by bluejacking your phone.
DRM protected files appear on your mobile with a key symbol.
you can get DRM at
http://developer.sonyericsson.com/
register and do a search for DRM
