Well, its always possible these people do have the phone, but without providing evidence such as a picture of the phone in their hands with maybe their name written on a bit of paper to the side, id say no.
Obviously, to people like us on Esato it stinks of a scam, but to unsuspecting buyers who dont even know the phones not even out for another 6 months or so they'd probably bid for it.
Like similar people did with the P910, S700i, and recently the K750, they all appeared on ebay months before release. So, it maybe be a scam, it may not be, but its certainly not worth the risk.
He might only be selling a preorder for the phone too.

i think this poor guy's account was hacked, because if you look at what he sells in the past it is all books and playbills.
