Stand you ground mate infact go here:
http://www.dti.gov.uk/ccp/topics1/facts/salegoodsact.htm
You have a LEGAL right to a refund within 30 days, they have no choice or they ARE breaking the law.

Thanks Miss C for that link. I think I may just have to fax it over to them.
I've now got as far as getting t-mobile to call up the store to explain to them that they are willing to cancel the contract and that the store HAS to refund the money. Just waiting to hear back from t-mobile.
I can't believe how thick the people I've been chatting to are (at the store). No matter how many times I state my statutory rights they turn round and say "yes, but our policy is a NO REFUND policy". I then state my statutory rights again... and again... and again! But still it does not sink into their heads that they HAVE to refund me. I even went as far as saying that I really did not want to waste my time going through the legal process, BUT if I had to then so be it.... And guess what??? They still didn't understand!!

I know people are just stupid, i have to feel for the staff some of the time they get this crap drummed into them right from the beginning...
I think it is safe to say you will get your money back and rightly so. Just remember this is what happens when you buy a windows mobile.
Just kidding. Good luck!

Well, here's a little update...
After constant arguing, a million and one phone calls, and the customer service dept at the head offices of the phone shop acting like infant school kids ("No, I refuse to listen to the fact that t-mobile have agreed to cancel the contract...la la la la la I cannot here you saying this to me so it's not true!!! - a slight exaggeration on my part there

) it looks like they have definitely said no to refunding my money.
So, it looks likely that I'll have to be writing to the trading standards people. I have so many more important things to do with my day than this!
If the worst comes to the worst, I've located some software that'll allow me to synch the phone with my Mac... but now it's a matter of principle and doing whats right.........

Miss C - name and shame time... its FONE HOUSE. And they are actually an official t-mobile dealership too which makes it all the more shocking!
I see that you are an Apple user too. If you don't mind my asking, other than you P910 do you use any other phones to synch to your mac?

Here's a list of all the officially supported by Apple phones:
http://www.apple.com/macosx/features/isync/devices.html
Others can be used too with third-party iSync plug-ins.

The only thing you could do is maybe sell the phone on ebay and put that toward's a P990i when it is released.
If you go to trading standard's then it may take awhile and if in the unfortunate event of you not recieving a refund the phone will have gone down in value.
Just a thought!
