I asked for a refund but had no reply to my texts yet, would even settle for enough of a refund to get a new battery and headphones, oh and still awaiting the unlock code!

It sounds like you've given them plenty of chances to sort things but they dont seem interested at all in doing so.
They would need to have an exceptional reason for acting the way they have for me not to take this further.
